Evaluating legal claims or exposure

We help clients critically evaluate their claims or legal exposure from the outset, to determine a dispute resolution strategy that is aligned with their commercial objectives. This is kept under review to take into account developments in the case and the broader commercial or political context. With considerable experience in managing quantum evidence, we can assist clients in quantifying their claims or exposure to damages consistently with the applicable legal and factual framework.

Avoiding or mitigating future disputes

International contracts may generate myriad legal and procedural risks and associated costs. We have seen such challenges materialise in disputes arising out of commercial, transactional, project and other agreements involving many different business relationships. We help clients draft robust dispute resolution and other contractual protections and can also review existing contracts and projects in order to prevent or mitigate disputes.

Protecting foreign investments

International treaties, free trade agreements and domestic investment legislation may provide investors with powerful remedies and leverage against States, through investment protection provisions and the right to pursue claims through international arbitration. With experience of many such instruments, we help investors structure their investments abroad to take advantage of investment protections, in the context of a transaction or before a dispute arises. Conversely, we can advise States on how to mitigate the risk of investment claims.
